Public notice is hereby given of the Waterways License Application by South Harbor Holdings, LLC
to maintain an existing mixed-use building, codify existing uses, authorize interior and exterior
after-the-fact change in use and proposed interior change in use, and construct a pile-supported
Harborwalk on filled and flowed tidelands of the South River at 283 Derby Street, Salem. The
proposed project has been determined to be nonwater-dependent.

The Department of Environmental Protection, Waterways Regulation Program, will conduct a
public hearing on the aforesaid project proposal on Thursday, November 29, 2018 at 4:00pm at
Salem City Hall Annex, 98 Washington St., 1st Floor Large Meeting Room, Salem. The Department
will conduct this public hearing in order to receive information to be used in its decision on
whether to grant a Waterways License pursuant to M.G.L. Chapter 91.

The Department will consider all written comments on this Waterways Application received by
Friday, December 21, 2018 (Public Comments Deadline). Failure of any aggrieved person or group
of ten (10) citizens or more to submit written comments to the Waterways Regulation Program by
the Public Comments Deadline will result in the waiver of any right to an adjudicatory hearing in
accordance with 310 CMR 9.13(4)(c). The group of citizens must include no less than five (5)
citizens who are residents of the municipality in which the proposed project is located.
